1. Introduction
Welcome to Quark Housing (“we”, “us”, “our”, the “Platform”). These Terms & Conditions (“Terms”) govern your use of the Platform and services offered via the website/app (the “Service”). By registering, accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
2. Eligibility
You represent and warrant that: you are at least 18 years old and have the legal capacity to enter into contracts; the information you provide during registration is complete, accurate and up-to-date; you will maintain and promptly update your account information.
3. Accounts & Security
You must create your account and select a password. You are responsible for keeping your credentials secure and confidential.
You accept responsibility for all activities that occur under your account.
If you suspect any unauthorized use of your account, you must notify us immediately.
4. Services & Usage
Quark Housing allows users (students, PG/hostel/room providers) to list, search, view and book properties.
You agree to use the Service only for lawful purposes and in accordance with these Terms.
You must not use the Service to:
post false, misleading or fraudulent listings;
infringe any third-party rights;
interfere with or damage the Service, its servers or networks;
use automated means (bots, scrapers) unless authorised.
5. Listings & Property Provider Obligations
Providers must ensure that all listings are accurate, complete, up-to-date and compliant with local laws.
Providers must own or have the legal right to offer the property for letting, and must disclose all relevant information (rent, deposit, amenities, rules).
Providers shall comply with all applicable housing, safety, fire, zoning and licensing regulations in the city/district.
6. Student / Renter Obligations
Renters must provide accurate personal details, agree to property rules, pay on time, maintain the property in good condition and behave responsibly.
Renters are responsible for complying with any house rules (noise, visitor policy, cleanliness) specified by the provider or Platform.
7. Fees & Payments
The Platform may charge fees to providers or renters (as applicable) for use of the Service (listing fee, booking fee, subscription).
Payments made through the Platform are subject to the terms and refund/cancellation policy displayed at the time of booking.
You agree to pay all fees when due. Late payments may incur interest or other penalties.
8. Refunds & Cancellations
Cancellation and refund terms for bookings will be as specified in the listing or at time of checkout.
Providers and renters should ensure they understand the policy before booking.
Refunds (if any) will be processed as per the payment mechanism and may take time to reflect.
9. Intellectual Property
All content on the Platform — text, graphics, logos, images, software — is owned by us or our licensors and is protected by law.
You may use the Service and content only for your personal or permitted use and may not copy, reproduce, modify or distribute any part without our written consent.
10. User Content
You retain ownership of any content you post (listings, reviews, photos) but grant us a worldwide, non-exclusive, royalty-free licence to use, display, modify, adapt and distribute such content for the purposes of operating the Service.
You represent that you have all rights to the content you upload and that it does not infringe any third-party rights.
We may remove or disable access to any content at our discretion if it violates these Terms or applicable law.
11. Prohibited Conduct
You must not:
violate any law, regulation or third-party right;
post offensive, defamatory, obscene or illegal content;
impersonate any person or provide false information;
attempt to gain unauthorised access to any part of the Service;
use the Service for any commercial purposes not authorised by us.
12. Disclaimers & No Warranties
The Service is provided “as is” and “as available”. We do not guarantee that the Service will be uninterrupted, error-free or secure.
We make no warranties (express or implied) about the accuracy, reliability or suitability of the Service for any particular purpose.
13. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any direct, indirect, incidental, special or consequential losses (including loss of data, profits, goodwill) arising from your use of (or inability to use) the Service.
Our total aggregated liability in any case will not exceed the total fees paid by you to us in the preceding 12 months (if any).
14. Indemnification
You agree to indemnify, defend and hold harmless Quark Housing, our officers, directors, employees and agents from any claims, liabilities, losses, damages, costs or expenses (including legal fees) arising from your violation of these Terms or your use of the Service.
15. Termination
We may suspend or terminate your account or access to the Service at any time, with or without cause, including if you breach these Terms.
Upon termination, you must cease using the Service and any rights granted to you will end.
16. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the [State of Delhi / India]. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of [Delhi].
17. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will post the updated Terms on the Platform with an updated “Last updated” date. Your continued use of the Service after such changes means you accept the new Terms.
18. Miscellaneous
If any provision of these Terms is found invalid or unenforceable, it will be severed and the remaining provisions will continue in full force.
Our failure to enforce any right or provision will not constitute a waiver of future enforcement of that right or provision.
These Terms together with our Privacy Policy and any other policy posted on the Platform constitute the entire agreement between you and us regarding the Service.
